M.V. Accord
Soon after it entered the territorial
jurisdiction of Bangladesh
the vessel lost both of its anchors. Pirates or local terrorist
tried to dismantle the vessel. At one stage the ship was arrested by an
order of the Admiralty Court.
The vessel was sold on auction.
Master, shipping agent, all the
crews of the vessel, cargo owner, foreign supplier, local people and
shipyard owner filed 31 suits against the vessel. We are representing the owner of the vessel since 2000. We
defended most of them successfully. Only 10 suits are pending in
the High Court Division and one in the Appellate Division.
One of the suits was decreed against the vessel
before we were engaged in the matter. One of the other suits, filed
by the cargo owner, was decreed because owner did not defend it
since they had a valid claim. Except two all other suits filed by
the crews were dismissed for default. However 10 of them has been
restored by the court upon applications by some of the crews.
Some local people conspired to
gain unlawfully from a foreign ship however after a long battle we
won against all of them.
At lease two of the decisions involving this vessel has
been report in different Law Journals of Bangladesh.
M.V. Ocean Hope & M.V. Ocean Heart
One of the vessels ran away from
the territorial jurisdiction of
Bangladesh
after short landing without informing the concerned authority. Cargo
owner came to know about the sister vessel and we applied for an
order of arrest of the sister vessel and successfully arrested a
sister vessel. Owner has released the vessel by furnishing bank
guarantee as security. It is now in trial stage.
M.V. Jebel-E-Rahmat
We defended on behalf of the owner of the vessel
against the claim of the insurance company and the cargo owner. The
vessel was arrested on an application filed by the cargo owner
and the insurer. This matter was settled out of court amicably. The
vessel has been released.
Subsequently the same vessel was arrested by
Legal Steps under a different cause of action which was also amicably
settled between the parties. This time we were working for another
cargo owner and on a different ground.
